1. INTRODUCTION AND SCOPE
This Refund Policy applies to all bookings, purchases, and services provided by Vital Ingredients and
Adventures GmbH, operating under the brand name The One Adventure. By completing a
booking,
you agree to this policy as an essential part of our Terms of Service.
This document has been meticulously designed in accordance with EU consumer law, Austrian law
(specifically the FAGG), and established industry standards for travel services. This policy is strictly
governed by Austrian law, though mandatory consumer protection rights of your country of residence
remain unaffected where applicable by law.
2. TOURS & ADVENTURE PACKAGES
2.1 Exemption from Statutory Right of Withdrawal In accordance with Austrian Consumer Protection
Law,
specifically § 18 Abs. 1 Z 10 FAGG, there is no statutory right of withdrawal for leisure services that
are
provided on a specific, scheduled date. By finalizing a booking for a tour or experience with us, you
expressly acknowledge and accept that standard withdrawal rights do not apply and that the specific
cancellation terms outlined below strictly govern your booking.
2.2. Standard Cancellation Timetable and Fees If you choose to cancel your booking, the following
cancellation fees will be definitively calculated based on the total tour price and the exact time your
written cancellation is received prior to the scheduled tour start date:
- From the date of booking until 90 days before the tour start date: A deposit equal to 20% of
the
total tour price is retained and is strictly non-refundable.
- Between 89 and 46 days before the tour start date: The cancellation fee will be 50% of the
total
tour price, or the retention of the original deposit, whichever amount is higher.
- Between 45 and 30 days before the tour start date: The cancellation fee will be 75% of the
total
tour price.
- 29 days to 0 days before the tour start date: A cancellation fee of 100% of the total tour
price
will be enforced, and no refund will be issued under any circumstances.
2.3. Cancellation Procedure and Payment Obligations All formal cancellation requests must be
submitted to the Company in writing via email.
A deposit amounting to 20% of the total tour price is due immediately at the time of booking and remains
non-refundable to secure your reservation. The remaining balance of your tour must be paid in full 21
days
before the official tour start date.
If you fail to pay the remaining balance on time, we reserve the right to cancel your booking
entirely, and
the applicable cancellation fees based on the timetable above will still be enforced. Furthermore,
if a
booking is explicitly cancelled by you after the balance due date has passed, the full remaining
amount
remains legally payable to the Company, regardless of your actual participation in the tour.
3. CANCELLATIONS BY THE ONE ADVENTURE
3.1. Company’s Right to Cancel We reserve the absolute right to cancel, postpone, or
significantly
modify
tours prior to departure due to several operational or safety factors. These factors include paramount
safety concerns , adverse weather conditions , insufficient participant numbers required to run the tour
,
unforeseeable force majeure events , or other unavoidable operational requirements.
3.2. Compensation and Remedies In the event that the Company must alter or cancel your tour, the
following conditions apply:
- If the tour is cancelled specifically for safety reasons or due to force majeure events, we will
endeavor to offer alternative travel arrangements or a future travel credit.
- If the tour is cancelled by us without a safety or force majeure justification, a full refund of the
tour price paid to us will be issued to you.
To the maximum extent permitted by applicable law, any further compensation claims against the
Company—including but not limited to reimbursement for independently booked flights, supplementary
travel
costs, or consequential losses—are strictly excluded.
4. MERCHANDISE AND PHYSICAL GOODS
4.1. Right of Withdrawal For the purchase of physical goods and merchandise from our website,
consumers are
legally entitled to a 14-day right of withdrawal under EU law.
4.2. Return Conditions To successfully exercise this right and qualify for a refund on physical
goods, the
following conditions must be met:
- The items must be entirely unused and returned in their original packaging.
- The return process must be formally initiated within 14 days of your receipt of the goods.
- The goods must then be physically dispatched and returned to us within 14 days after you have
provided
your notice of withdrawal.
- The customer bears all return shipping costs, unless the item delivered was demonstrably defective
or
damaged upon arrival.
5. REFUND PROCESSING TIMELINES
Once a refund has been formally approved by our team, it will be processed within 14 days of that
approval
date. All approved refunds are issued strictly via the original payment method used at the time of
purchase.
In the case of returned physical merchandise, we reserve the right to withhold the processing of refunds
until the returned goods have been successfully received and inspected at our facilities.
6. STRICTLY NON-REFUNDABLE ITEMS AND SERVICES
For the avoidance of doubt, the following items, purchases, and scenarios are strictly non-refundable:
- Initial deposits paid for tours.
- Last-minute tour bookings made within 29 days before the scheduled departure date.
- Any services or tour components that have already been performed or utilized.
- The purchase of digital products or digital downloads.
- Any custom-made or personalized physical items.
- Any unused services during the tour or instances of a "no-show" by the participant.

booking. Ensure your policy covers trip cancellations, medical emergencies, and the specific adventure
activities detailed in your itinerary.
