Terms & Conditions (AGB)

Scope

These Terms and Conditions apply to all services, travel arrangements, digital products, and merchandise sold through www.theoneadventure.com, operated by Vital Ingredients & Adventures GmbH. Deviating terms apply only if confirmed in writing.

Booking Process

A booking becomes binding when the customer receives written confirmation. By submitting a booking, the customer makes a binding offer pursuant to § 862 ABGB.

Services Provided

Services are defined by the tour description at the time of booking. Minor necessary modifications (weather, safety, logistics) do not constitute defects.

Participant Requirements

Participants must meet all stated fitness, safety, and skill requirements. Relevant health conditions must be disclosed. The One Adventure may exclude participants who endanger themselves or others.

Payment Terms

Unless otherwise stated:
• 30% deposit at booking
• Remaining balance 30 days before departure
Failure to pay may result in cancellation according to § 918 ABGB.

Cancellation by Customer

Unless otherwise stated:
• Up to 30 days before departure: 20% fee
• 29–14 days: 50% fee
• 13–7 days: 75% fee
• <7 days: 100% fee

Legal Note: The right of withdrawal under the Distance Selling Act (FAGG) does NOT apply to leisure/tourism services scheduled for specific dates (§ 18 Abs 1 Z 10 FAGG).

Cancellation by The One Adventure

Tours may be cancelled due to force majeure, safety concerns, insufficient participants, or reasons beyond company control. Customers receive a full refund but no additional compensation.

Liability

Adventure activities carry inherent risk. Participation is voluntary and at the customer’s own responsibility.

The One Adventure is only liable for:
• Intentional damage
• Gross negligence

Excluded from liability:
• Loss of personal items
• Injuries caused by participant negligence
• Third-party service failures
• Changes due to weather, safety, or force majeure

Insurance

No insurance is included unless stated. Customers should obtain travel, accident, and medical insurance.

Package Travel Act (PRV)

Tour operator license pending. Upon approval, insolvency protection will be provided according to PRV standards and published here.

Data Protection

All data is processed in accordance with GDPR. See our Privacy Policy.

Jurisdiction & Law

Austrian law applies. Place of jurisdiction is Vienna, unless mandatory consumer jurisdiction applies.

Changes to AGB

We may amend these AGB at any time. The version valid at booking applies.
